The United States Supreme Court ruled 6–3 on Tuesday to invalidate an executive order issued by Donald Trump that sought to restrict birthright citizenship.
The Court held that, under the Fourteenth Amendment to the U.S. Constitution, nearly all children born on U.S. soil are entitled to American citizenship, regardless of their parents’ immigration status or nationality.
In the majority opinion, Chief Justice John Roberts emphasized that citizenship is a fundamental constitutional right and that the Fourteenth Amendment guarantees this protection to individuals born in the United States.
The ruling invalidates Trump’s executive order, which had directed federal agencies not to recognize the citizenship of children born in the U.S. to parents who were neither U.S. citizens nor lawful permanent residents.
